1) Scope
This Policy applies to:
Website visitors who browse the Site or interact with forms, chat, scheduling, or cookies.
Leads and clients who contact us or purchase our Services.
End users of our clients only to the extent we receive their personal data from our clients in order to provide Services (e.g., CRM data, messages, recordings). In those situations, our client is typically the “controller/business,” and we act as a “service provider/processor” on their behalf.
Our Services are intended for U.S. customers and U.S.-based operations.
2) Information We Collect
We collect information from you, automatically from your device, and from third parties (like our service providers), depending on how you interact with us.
A) Information you provide
Contact details: name, email, phone number, company name, and similar details when you submit a form, request a quote, book a call, or communicate with us.
Communications: messages you send us by email, chat, phone, SMS, or social media.
Project/client information (for clients): website content, files/assets, brand materials, logins/credentials or API keys you provide, automation rules, and support requests.
Call/SMS data (when used): call recordings, call transcripts, voicemails, messages, and scheduling details when these features are enabled for your account or your interaction with us.
B) Information collected automatically
Device and usage data: pages viewed, clicks, referring pages, approximate location derived from IP address, browser/device information, and diagnostic data.
Identifiers: IP address, cookie IDs, device identifiers, and similar online identifiers.
Cookies and similar technologies: see Section 6.
C) Payment information
If you pay for Services, payments are typically processed by our payment/commerce tools and processors (for example, through GoHighLevel-integrated payments). We may receive limited billing data such as payment status, plan level, invoice history, and last-4 digits depending on configuration, but we do not necessarily receive full payment card numbers.
D) Sensitive information
We do not intentionally collect sensitive personal information (e.g., Social Security numbers, precise geolocation, health data). Please do not submit sensitive information through our forms, chat, or SMS unless we specifically request it in writing for a project.
E) Children’s information
Our Services are not directed to children, and we do not knowingly collect personal information from children.
3) How We Use Information
We use personal information to:
Provide the Services (website builds, hosting/maintenance, automations, AI chat/voice assistants, lead routing, scheduling).
Communicate about inquiries, quotes, onboarding, support, and account administration.
Operate and improve our Site and Services (analytics, troubleshooting, QA).
Security and fraud prevention (detect/prevent abuse, protect our systems, enforce our terms).
Marketing (e.g., responding to inquiries, sending service updates, promotional messages where permitted).
Legal compliance and enforcing agreements.
We only use information as needed for the purposes described above, and we aim to collect only what we reasonably need. (Federal Trade Commission)
4) SMS, MMS, Phone Calls, and Consent
If you provide your phone number, you may receive calls and/or text messages (SMS/MMS) from Sea Breeze Sites for purposes such as:
responding to your inquiry,
appointment scheduling/confirmations/reminders,
support communications,
follow-ups related to requested services.
Message frequency varies. Message and data rates may apply.
Opt-in / Consent
You opt in by providing your phone number through our forms, chat, booking widget, or other methods we provide at the point of collection (for example, a checkbox or keyword flow). Consent is not a condition of purchase. For marketing texts, applicable law generally requires clear prior express consent (and in many cases prior express written consent).
Opt-out / Help
To opt out: reply STOP to any message.
For help: reply HELP or email [email protected].
Carrier notice
Carriers are not liable for delayed or undelivered messages.
5) AI, Chatbots, Voice AI, and Automated Processing
We may use AI tools to help deliver certain features (for example, chatbot responses, voice AI call handling, drafting, summarization, or workflow automation).
No legal/“significant effects” decisions: We do not use automated decision-making that produces legal or similarly significant effects about individuals (e.g., credit, employment, housing decisions).
Training/fine-tuning: We do not use your personal information to train or fine-tune our own AI models.
AI service providers: Some AI features may send inputs to AI vendors (e.g., OpenAI) solely to provide the feature. OpenAI’s API policies state that data sent via the API is not used to train models by default unless the customer opts in.
Important: Do not submit confidential or sensitive information through chat, SMS, or voice AI unless you have confirmed with us in writing that it is required for your project.
6) Cookies, Analytics, Advertising, and Global Privacy Control
We use cookies and similar technologies for:
Essential functions (site operation, security, preferences),
Analytics (understanding site usage),
Advertising/remarketing (measuring performance and showing ads).
Your choices
Browser controls: You can manage cookies through your browser settings (disabling cookies may affect site functionality).
Opt-out of targeted advertising: See Section 9.
Global Privacy Control (GPC): Where required, we treat browser-based GPC signals as a valid request to opt out of “sale/sharing” for cross-context behavioral advertising. (California DOJ)
7) How We Share Information
We may share personal information in the following circumstances:
A) Service providers (processors)
We share information with vendors that help us provide the Services (e.g., CRM, scheduling, hosting, analytics, communications tools, payment processors, AI providers). These vendors process data under their terms and/or on our instructions depending on the service.
B) Advertising/remarketing partners
If we use remarketing/advertising tools, we may disclose certain identifiers (cookie IDs, device IDs, event data) to advertising partners to measure performance and deliver ads. Under some state laws (including California), this can be considered “sharing” for cross-context behavioral advertising. (California DOJ)
C) Legal and safety
We may disclose information if required by law or if we believe disclosure is necessary to comply with legal process, protect rights and safety, or investigate fraud/security issues.
D) Business transfers
If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.
We do not sell personal information for money. We do not knowingly sell or share children’s data.
8) Mobile Information Sharing Statement
No mobile information will be shared with third parties/affiliates for their own marketing or promotional purposes.
We may share mobile information with service providers who help us deliver messaging/calling services (for example, platforms that send messages, provide calling, scheduling, or CRM functionality), but only to provide the Services and not for those third parties’ independent marketing use.
9) Data Retention
We retain personal information for as long as reasonably necessary to:
provide the Services,
maintain our business relationship,
comply with legal obligations,
resolve disputes,
enforce our agreements.
When you request deletion, we will delete or de-identify personal information unless we must keep it for legal/security reasons.
Backups: Residual copies may remain in backups for a limited period until rotated/overwritten.
10) Data Security and Handling
We use reasonable administrative, technical, and physical safeguards designed to protect personal information, which may include encryption in transit and/or at rest where appropriate, access controls, and least-privilege practices. No method of transmission or storage is 100% secure. (Federal Trade Commission)
You are responsible for maintaining the confidentiality of credentials you share with us.
11) Your Privacy Rights and Choices
Depending on where you live, you may have rights to:
Access the personal information we hold about you,
Correct inaccurate information,
Delete personal information (subject to legal exceptions),
Opt out of certain processing such as “sale/sharing” for targeted advertising, where applicable. (California DOJ)
Opt-out of marketing
Email: use the unsubscribe link (if provided) or email us.
SMS: reply STOP (service/transactional messages may still be sent when permitted).
How to exercise rights
Email [email protected] with the subject line “Privacy Request” and tell us what you want to do (access/correct/delete/opt-out). We may ask you to verify your identity. Certain laws also contemplate describing categories collected, purposes, and retention—this policy is intended to satisfy those general notice concepts. (California Privacy Protection Agency)
12) International Data Transfers
We primarily operate in the United States. However, some vendors we use may process data in other locations depending on their infrastructure. If cross-border processing occurs, we rely on appropriate safeguards as required by applicable law.
13) Third-Party Links and Client Sites
Our Site (and sites we build for clients) may link to third-party websites or services. Their privacy practices are governed by their own policies, not ours.
14) Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version on our Site and revise the “Effective Date.” Material changes may be communicated via the Site or by email where appropriate.
